E-prescription regulation, A Step taken by the Govt of India that has had published draft rules and invited suggestions from the consumers for amending the Drug and Cosmetic Rules, 1945. The aim of the amendment was to manage the web sale of medicines and medicines. This move is going to be extremely beneficial for consumers to get genuine medicines from reliable web portals. This initiative also will end in moving a step closer towards the achievement of success of the Digital India program.
This initiative was trapped up during a legal battle with several organizations which represented chemists and pharmacists having filed petitions across various courts within the country as they were against the concept of e-pharmacies. Chemists and pharmacists are opposing the initiative of e-prescription regulation the web sale of medicines as they’re of the view that easy availability of medicine and medicines may cause their misuse.
The draft rules e-prescription regulation state that nobody is going to be eligible to sell, distribute or offer to sell drugs through an e-pharmacy unless such person is registered with the applicable authority. The Govt of India within the draft rules envisioned that the small print of the patient is going to be kept confidential and can not be disclosed to a person aside from the Central Government or the concerned government . It’ll be pertinent to say that the registrant of the e-pharmacy is going to be required to use it for registration with the Central Licensing Authority. The appliance for registration is going to be required to be accompanied with a sum of INR 50,000.
At present there’s no mechanism to verify whether the medical prescription submitted to a web pharmacy is genuine. Hence, there’s a yawning gap within the Statute addressing the difficulty of sale of medicines online and patchwork of filling to make the Statute effective and workable during this cyber age is the need of the hour. Resultantly, such transactions are repeatedly susceptible to fraud.
